Terms of Service

These terms apply when you install or use PopupGenius (“the app”, “we”, “us”), a Shopify app that creates AI-designed popups for your store. By installing the app you agree to them. If you install it on behalf of a business, you confirm you’re authorised to accept these terms for that business. PopupGenius is a tool for merchants running a business, not a consumer product.

The service

PopupGenius lets you create, edit, target and A/B test popups on your Shopify storefront, apply discounts through Shopify, and capture shopper leads into your Shopify customer list. It runs as a theme app extension and needs an Online Store 2.0 theme. We may add, change or remove features over time; we’ll give notice before removing anything your plan depends on.

Plans, trials & billing

  • Paid plans are billed through Shopify, in USD, on a recurring monthly basis, and appear on your Shopify invoice. We never see or store your payment details.
  • Every paid plan starts with a 7-day free trial. You aren’t charged if you cancel before it ends.
  • Each plan includes the popup-view and AI-credit allowances shown on our pricing. Going beyond them may require moving to a higher plan.
  • The Free plan is available on Shopify development stores only.
  • You can switch plans or cancel at any time from your Shopify admin; uninstalling the app cancels your subscription. Except where the law requires otherwise, fees already charged aren’t refunded, including for part of a billing period.
  • If we change a plan’s price, Shopify asks you to approve the new price before you’re charged it.

AI-generated content

PopupGenius uses AI to generate popup designs and copy from your storefront and the instructions you give it. AI output can be wrong or unsuitable, so review every popup before you publish it. You decide what goes live on your store.

Your responsibilities

  • The offers, discounts, prices and claims your popups show to shoppers are yours, and so is making sure they comply with the consumer-protection and advertising rules that apply to your store.
  • When you capture emails or phone numbers, you’re responsible for having a lawful basis to market to those shoppers under the rules that apply to you (for example GDPR or CAN-SPAM).
  • Don’t use PopupGenius to show unlawful, deceptive or infringing content, to collect data you’re not allowed to collect, or to attempt to get around plan limits, reverse-engineer the app, or disrupt the service.

Your content & data

You keep ownership of your store content, your popups and the leads you capture. You give us permission to use them only as needed to run the app for you. How we handle personal data is described in our Privacy Policy.

If you choose to publish a template for other merchants, you allow us and other PopupGenius merchants to use and adapt it within the app, free of charge. Only publish templates you have the rights to, and leave out anything confidential.

Third-party services

The app runs on Shopify, and your use of Shopify is governed by Shopify’s own terms. We use Google’s Gemini API to generate designs. We aren’t responsible for outages or changes in services we don’t operate, though we’ll work to limit their impact on you.

Suspension & termination

You can stop using PopupGenius at any time by uninstalling it. We may suspend or end your access if you seriously or repeatedly breach these terms, misuse the service, or if Shopify stops us from offering the app to your store. When access ends, your data is deleted as described in the Privacy Policy.

No guaranteed results

We build PopupGenius to help lift conversions and order value, but results depend on your store, traffic and offers, and we can’t guarantee any particular outcome. The app is provided “as is” and “as available”, to the extent the law allows.

Limitation of liability

To the extent the law allows, we aren’t liable for indirect or consequential losses such as lost profits, revenue or data, and our total liability for any claim is limited to the fees you paid us in the 12 months before it arose. Nothing in these terms limits liability that can’t be limited by law, such as liability for intent or gross negligence.

Changes to these terms

We may update these terms. If a change materially affects you, we’ll let you know in the app or by email before it takes effect. The date at the top shows the latest version.
